Michigan Attorney General Mike
Cox Shows His True Colors

Many Michigan residents remember how Michigan Attorney General
Mike Cox was forced to disclose in 2005 that despite his campaign platform that "marriage means one man and one woman", for Cox marriage meant one man and two women.
Cox also ran on the platform that he would "enforce
the laws as written by the Legislature". As described
below, Cox has again been exposed as a charlatan.
In February, 2009, StateBarWatch invoked the procedure pursuant
to MCL
600.4501 to request that AG Mike Cox remove Timothy Raubinger as
the Assistant Secretary of the Michigan Board of Law Examiners
because the Assistant Secretary's position should be filled by
Supreme Court Clerk Corbin Davis. Michigan Law, MCL
600.922 states:
There is hereby
constituted a board of law examiners consisting of 5 active members
of the bar each of whom shall hold office for 5 years and 1 of whom
shall be appointed by the governor on nomination by the supreme
court on the first day of July in each year. Vacancies on the board
shall be filled in like manner for the unexpired term. The president
of the board is the member of the board whose term first expires.
The board shall elect a secretary annually from its own membership. The
clerk of the supreme court ex-officio is the assistant secretary and
treasurer of the board. If a vacancy occurs in the office of
president, the board may elect a president for the unexpired term
from its own membership.
The clerk of the supreme court is presently Corbin Davis, not
Timothy Raubinger. Therefore, it is easy to see that AG Cox was
legally obligated to remove Mr. Raubinger from the Assistant
Secretary's position.
On February 24, 2009, Cox again showed his true colors when he
refused to take action. Click

StateBarWatch is presently researching its options.
StateBarWatch may bring the quo warranto action or it may bring a
mandamus action against Cox seeking an Order requiring him to do his
job. We will keep you informed of our decision.
